In accordance with the "Law of the People's Republic of China on the Prevention and Control of Occupational Diseases" and its supporting regulations, employers bear primary responsibility for occupational disease prevention and control. The legal framework mandates that enterprises implement a three-tiered prevention strategy: primary prevention focusing on hazard source elimination and engineering controls, secondary prevention emphasizing early detection through regular occupational health examinations, and tertiary prevention aimed at preventing disability progression and promoting rehabilitation.
From an occupational hygiene perspective, the identification and assessment of occupational hazards constitute the foundation of any effective prevention program. Enterprises must conduct systematic workplace hazard identification, including but not limited to chemical agents (such as organic solvents, heavy metals, and dust), physical factors (noise, vibration, heat stress, and ionizing radiation), biological hazards, and ergonomic risk factors. Quantitative exposure assessment through industrial hygiene monitoring is essential to determine whether workplace concentrations of hazardous agents comply with the Occupational Exposure Limits (OELs) established by national standards.
The hierarchy of controls remains the guiding principle in occupational hazard mitigation. Engineering controls—including process enclosure, local exhaust ventilation, and substitution with less hazardous materials—represent the most effective intervention. Administrative controls, such as job rotation and reduced exposure duration, serve as supplementary measures. Personal protective equipment (PPE) functions as the last line of defense and must be selected based on specific hazard characteristics, with proper fitting, training, and maintenance protocols.
Occupational health surveillance programs are legally required for workers exposed to designated occupational hazards. These programs encompass pre-employment, periodic, and post-employment health examinations, with specific testing protocols determined by the type of occupational exposure. Health surveillance data must be documented in individual occupational health records and retained for the legally mandated duration. When abnormal findings are detected, employers are obligated to implement timely interventions, including workplace reassessment, exposure reduction, and where necessary, job reassignment.
Enterprises must also establish comprehensive occupational health management systems, including designated occupational health management personnel, standardized operating procedures, emergency response plans for acute occupational poisoning incidents, and regular occupational health training programs. The allocation of adequate budgetary resources for occupational disease prevention is both a legal obligation and a practical necessity.
Non-compliance with occupational disease prevention regulations exposes enterprises to significant legal liabilities, including administrative penalties, civil compensation claims, and potential criminal prosecution in cases of serious outcomes. Beyond regulatory compliance, effective occupational disease prevention contributes to reduced absenteeism, enhanced workforce productivity, and improved corporate social responsibility performance.
